When outsourcing spreads wings for litigation works

New Delhi - Outsourcing is the brainchild of India. “Outsourcing principles such as moving from an individual mindset to a process mindset and from a skill set focus to a replicating ability are all applicable to LPOs as well. There are caveats though. Legal processes, for example, do not necessarily need the same kind of technological or automated output as banks,” says Dinesh Sawant, chief operating officer of ClutchGroup.

The growth areas, Abhi Shah says, include SEC-related work in areas such as compliance and anti-money-laundering, foreclosures, and discovery for litigation. With market values collapsing, "Securities-fraud litigation is the biggest thing coming down the pike," says Shah. Then there will be compliance related to new legislation linked to the bailouts: "This will trump Sarbanes-Oxley," he exclaims, referring to the law that was supposed to improve transparency.

The slowdown is indeed a blessing in disguise for the LPO industry.
Lay-offs have become a universal phenomenon and yet they remain the most uncommon practice in the LPO (Legal Process Outsourcing) industry. With Clutch Group (formerly JuriMatrix, the Bangalore-based LPO backed by Jerry Rao) planning to hire at all levels including associate and project manager level lawyers in India, the LPO industry is bucking the slowdown. While every firm is looking at lowering their costs, it is the LPOs that are turning others' cost-saving to their advantage.

Shah describes one large law firm client that signed on with Clutch Group for an 80-attorney document review on a case related to the financial crisis, but kept it on shore. Three months into the project, as cost shot up, the firm tested Indian waters and moved five attorneys offshore. Three weeks later, the number doubled to 10, and two months later, it tripled to 30.

From SOX to subprime,
major developments of the past few years confirm outsourcing as
a fact of life for law firms. It all comes as no surprise to Abhi
Shah, CEO of The Clutch Group, which, with offices in Bangalore
and throughout the United States, provides a distinctively global
outsourcing strategy. The marketing message is pretty clear: Shah
calls it the “Inevitability Concept,”

Clutch

The idea that companies or law firms would turn to legal outsourcing providers
for help during busy season seems foreign to many. But Abhi Shah, chief executive officer of legal services provider the Clutch Group, says the subprime crisis is shining a new light on the outsourcing of legal services.Whether it's corporate in-house counsel defending a company against a class action lawsuit or law firms dealing with an influx of subprime-related cases, Shah expects Clutch's model will prosper as attorneys become inundated with subprime-related work and search for available outsourcing partners who can assist them with everything from research to legal document review.

Bad times for some
American companies is turning into good times for India’s
legal offshoring industry. For reasons largely economic and partly
cultural, India’s legal process outsourcing, or LPO, services
providers have seen a sizeable uptick in business since the US economy
has faltered. In particular, firms that handle support functions,
such as reviewing documents and researching witnesses for US litigation,
have enjoyed the biggest increases amid mounting disputes over who
knew what and when in the mortgage and related markets meltdown.

Legal Outsourcing Increases As Economy
Stagnates
May 02, 2008 |
|
|
|
|
|
With the U.S. economy in a tailspin, outsourcing companies say that
law firms and corporations are increasingly seeking to drive down
costs by turning to them for document review and other low- to mid-level
legal work. Even before the subprime mortgage crisis hit, the number
of legal process outsourcing firms and the revenue they brought in
more than doubled from 2005 to 2006, according to ValueNotes Research.
The research company expects the legal process outsourcing industry
to grow from an estimated $62 million in 2005 to $640 million in 2010,
with about 32,000 attorneys, scientists and professionals employed
by LPO providers.

The argument that offshoring,
as a practice, can create tremendous employment opportunities is now
largely uncontested. It has been validated time and time again, and
India is a shining example, arguably the best example. The Indian
BPO industry, which currently employs 6.5 million people, has become
the stuff of stories and legends. People have made their careers not
just in the industry but even ‘on’ the industry, through
bestsellers and big-screen blockbusters!

NEW DELHI: Cost, quality and efficient leadership
are the three potent forces that would ensure greater tapping of offshored
work by the country's Legal Process Outsourcing (LPO) industry. The
Indian LPO industry, which is still at an evolving phase, is set to
grab a major part of the global offshoring business, keeping in conformity
with its high-end competitive advantages, a seminar recently held
in the capital noted. The seminar on "Careers in the LPO industry"
stressed the need to ensure high-quality legal work rather than bulk
low-quality work.
